Talkcircle LLC., its subsidiaries and affiliates (“Talkcircle“, “we“, “us“, “our“) take your privacy seriously and has developed this Privacy Policy (“Privacy Policy“) to explain what we collect from our users (“users“ or “you“) and how we use and share this information. This Privacy Policy applies to your use of our websites, mobile websites, mobile applications and any related services (“Platform“) which you can find out about more in our Terms of Service at [https://talkcircle.com/en/privacy]. We may change this Privacy Policy from time to time and will notify you by revising the date at the top of the Privacy Policy. Please review this Privacy Policy whenever you access the Platform to stay informed of our information practices.
WHAT INFORMATION DOES TALKCIRCLE COLLECT?
This Privacy Policy covers our treatment of “personally identifiable“ information (meaning it can be used to specifically identify you as a unique person) (“Personal Information“) or “nonpersonally identifiable“ information (meaning it cannot be used to specifically identify you) that we may collect in your use of the Platform.
We use both types of information, and combinations of both types, as described in this Privacy Policy. This Privacy Policy does not apply to the practices of any other company or individual that we do not own or control.
WHEN YOU REGISTER FOR OUR SERVICES.
We receive and store information that you provide to us when registering with the Platform such as your name, age, username, password, country of location, profile image, and email address.
WHEN YOU VISIT OR USE THE PLATFORM.
Even if you do not register with us, whenever you interact with the Platform, we may collect the following: IP address, language setting, operating system type, the page you requested, an Identifier for Advertising if you are using an iOS device or an Android ID if you are using an Android device, user agent, and time stamp. We collect information about your search and click activity on the Platform, or your user generated content or activity related to your use of the Platform.
COMMUNICATION WITH ADVISORS
While using the Platform you and any a counsellor, medical professional, therapist, expert, or other medical advisor (“Advisors“) may convey information to each other by means of text-based communication (such as messages), verbal communication or video communication, either internally or to each other (collectively “Session Content“) to enable the Advisor to provide services to you.
The Session Content may be also used, either by itself or in conjunction with other information, for the following purposes:Please note that while we may monitor your use of the Platform, we do not record private conversations between you and any Advisors that you may engage via the platform.
WHEN YOU TURN ON LOCATION SERVICES.
If any aspect of the Platform allows us to determine your geo-location relative to nearby merchants with whom we’ve partnered so that we can provide you notifications of promotional deals or other specific offers or services that may be of interest to you. When you have allowed us to access your location, we may access your geo-location even if you are not using the Platform.
HOW DOES TALKCIRCLE USE YOUR INFORMATION?
We may use the information we collect for the various purposes described below:
AGENTS.
We employ other third party vendors, consultants and other service providers who need access to your information to perform work on our behalf.
BUSINESS TRANSFERS.
We may share your information in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition, or in any other situation where personal information may be disclosed or transferred as one of our business assets.
ENFORCEMENT OF TERMS AND POLICIES.
We may share your information to enforce or apply our Privacy Policy, Terms of Service or our other policies or agreements.
PROTECTION OF TALKCIRCLE AND OTHERS.
We may access, read, preserve, and disclose any information that we reasonably believe is necessary to comply with law or court order; or protect the rights, property, or safety of Talkcircle, our employees, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
HOW MAY TALKCIRCLE COMMUNICATE WITH ME?
We may contact or communicate with you by email, notices on our websites or applications, newsletters or other means available through the Platform, including mobile text message and push notifications. Such communications may contain messages of a commercial or noncommercial nature, including but not limited to, providing you the Service or response to your inquiry that you requested, marketing and promotions of the Platform or the services of our partners and advertisers, administrative purposes, or to carry out other purposes described in this Privacy Policy.
HOW DOES TALKCIRCLE USE COOKIES AND WEB BEACONS?
“Cookies“ are small data file identifiers that are transferred to your computer or mobile web browser that allow us to recognize your browser or mobile device and transfer information about you and your use of the Platform. For example, cookies that we use tell us how many times you have visited one of our websites, your search preferences, and if you have clicked on an advertisement that has been displayed to you. We use “persistent“ cookies to save your login information for future logins to the Platform. We also use “session ID“ cookies to enable certain features of the Platform, to better understand how you interact with the Platform and to monitor aggregate usage by users and web traffic routing on the Platform. Unlike persistent cookies, session ID cookies are deleted from your computer when you log off from a Service and close your browser. We, and third parties with whom we partner, may also deliver a file knowns as a web beacon, pixel or pixel tag (“Web Beacons“) to you through the Platform from an ad network. Web Beacons are small, invisible graphic images that may be used on the Service interface or in emails relating to the Service to collect certain information and monitor user activity on the Service interface, such as to count visits, understand usage effectiveness and to determine if an email has been opened and acted upon. Web Beacons allow ad networks and service providers that we use to provide anonymized, aggregated auditing, research and reporting for us, for advertisers and our other partners. Web Beacons also enable ad networks to serve targeted advertisements to you when you visit other websites. Because your web browser must request these advertisements and Web Beacons from the ad network’s servers, these companies can view, edit, or set their own cookies, just as if you had requested a web page from their site.
WHAT CHOICES DO I HAVE?
✪ Cookies. You can usually instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from our websites that you visit. If you do not accept cookies, you may not be able to use all portions of the Platform or all functionality of the Platform. ✪ Email. You can always choose not to disclose information to us or delete information, but keep in mind some information may be needed to register with us or to take advantage of some of our special features. You may request deactivation of your account by contacting us at help@talkcircle.com ✪ Push Notifications. You may adjust the “Settings“ on your mobile device to disable push notifications for any of our mobile applications for which you would like to stop receiving such notifications.
PAYMENT CARD INFORMATION
To use certain aspects of the Platform, we may require credit or debit card account information. By submitting your credit or debit card account information through the Platform, you expressly consent to the sharing of your information with third party merchants, subscription and billing processors, and payment processors. Currently Stripe collects your credit or debit card account information and processes such payments with their financial institutions. Stripe may store your credit or debit card account information so you can use the Platform in the future and any information that you provide to Stripe will be subject to Stripe’s terms and conditions of service and privacy policy. Talkcircle does not keep your complete credit or debit card account information, store your credit or debit card account information, or have direct control over or responsibility for your credit or debit card account information. While we require that Stripe uses reasonable procedures to help protect your credit or debit card information, we cannot guarantee that transmissions of your credit or debit card account information or personal information will always be secure or that unauthorized third parties will never be able to defeat the security measures taken by us or our third-party service providers. We assume no liability or responsibility for disclosure of your information due to errors in transmission, unauthorized third-party access, or other causes beyond our control.
SECURITY
We use commercially reasonable safeguards to preserve the integrity and security of information collected and maintained through the Platform. However, we cannot ensure or warrant the security of any information you provide to us or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed by unauthorized persons or hardware or software failure.
DO NOT TRACK
We currently do not participate in any “Do Not Track“ frameworks that would allow us to respond to signals or other mechanisms from you regarding the collection of your information. We may engage third parties, such as marketing or analytics partners, who may collect information about your online activities over time and across different websites when you use our website.
DATA RETENTION
You may review, update, correct or delete the Personal Information in your account by contacting us or by editing it online.
If you would like us to delete your Personal Information or any other information from our system, please contact us with such request. We will use commercially reasonable efforts to honor your request. However, we may retain an archived copy of your records as required by law for legitimate business purposes or for recordkeeping purposes.
There may also be residual information that will remain within our databases and other records, including, without limitation, some data may that may be still archived and stored offline. We are not responsible for removing information from the third parties that we have already legitimately shared Personal Information about you.
SERVICES NOT DIRECTED TO CHILDREN
The Platform is not directed to children under 18. We do not knowingly collect or solicit personally identifiable information from anyone under the age of 18. If you are under 18, please do not attempt to register for the Platform or send any information about yourself to us. If a parent or guardian becomes aware of the fact that his or her child has provided us with personal information without their consent, please contact us at help@talkcircle.com
INTERNATIONAL TRANSFER
Your information may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. By submitting such information, you consent to that transfer.
